Terms & Conditions of Service

Please read these terms and conditions carefully before using our ice distribution services

1. Agreement to Terms

By placing orders with The Great Success ("we," "us," or "our"), you agree to be bound by these Terms and Conditions and all applicable laws and regulations. These terms govern your use of our ice distribution services, including website usage, orders, and deliveries.

These terms apply to all customers, visitors, and users who access or use our ice distribution services.

2. Ordering and Payment Terms

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason at our discretion.

  • Orders must be placed through our official channels (website, phone, or email)
  • Payment is due upon delivery unless credit terms have been established
  • Prices are subject to change without notice
  • Bulk orders require a 50% deposit for orders over R5,000
  • Contract customers receive preferential pricing as per agreement

3. Delivery Terms and Conditions

Our delivery service operates within specified areas and timeframes. By accepting delivery, you agree to the following terms:

Delivery Information

Standard delivery within 4 hours for orders placed before 2 PM. Emergency delivery available 24/7 with additional charges.

  • Delivery times are estimates and not guaranteed
  • Someone must be available to receive the delivery
  • Additional charges apply for remote or difficult access locations
  • We are not liable for delays caused by circumstances beyond our control
  • Refused deliveries will incur a restocking fee of 25%

4. Product Quality and Storage

We guarantee the quality of our ice at the time of delivery. Proper storage after delivery is the customer's responsibility.

Our ice is manufactured to food safety standards and is crystal clear, slow-melting premium quality.

  • Ice should be stored in insulated containers immediately after delivery
  • We are not responsible for melting after delivery acceptance
  • Quality complaints must be reported within 2 hours of delivery
  • Returns are not accepted for melted or improperly stored ice

5. Contract Service Terms

Contract customers enjoy preferential pricing and scheduled deliveries under specific terms:

Minimum 3-month commitment required
7-day notice required for schedule changes
Invoicing on 30-day terms for approved accounts
Early termination fees may apply

6. Cancellation and Refund Policy

Cancellation and refund requests are handled according to the following guidelines:

Cancellation terms vary by order type:

  • Standard orders: Cancel up to 2 hours before delivery for full refund
  • Emergency orders: 50% cancellation fee if cancelled after dispatch
  • Contract orders: 30-day written notice required for termination
  • Event orders: 48-hour notice required for full refund

7. Limitation of Liability

In no event shall The Great Success be liable for any indirect, punitive, incidental, special, or consequential damages arising from:

  • Improper storage or handling of ice after delivery
  • Delays caused by weather, traffic, or other uncontrollable factors
  • Equipment failure at customer premises
  • Third-party actions or events beyond our reasonable control

Our maximum liability for any claim shall not exceed the value of the specific order in question.

8. Customer Responsibilities

Customers are responsible for ensuring:

Provide accurate delivery information and ensure safe access for our delivery personnel.

  • Providing accurate delivery addresses and contact information
  • Ensuring safe and accessible delivery locations
  • Proper storage facilities for ice upon delivery
  • Timely payment according to agreed terms
  • Reporting any issues within specified timeframes

9. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters and extreme weather conditions
  • Power outages and utility failures
  • Government actions or restrictions
  • Labor disputes and strikes
  • Equipment breakdowns beyond our control

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of Polokwane, Limpopo.

11. Changes to Terms and Conditions

We reserve the right to modify or replace these Terms at any time. Significant changes will be communicated to contract customers via email and to all customers through website updates.

By continuing to use our services after changes become effective, you agree to be bound by the revised terms.
